Five principles of Staff Transfer
On February 2, 2009, the Supreme Court in Taiwan, made sentence on litigation about a company's staff transfer. This case let us realize that when transferring employee, there are still some rules to abide which called "Five principles of Staff Transfer" promulgated by Ministry of the Interior as followed.
1.Based on the necessity of business operation needs.
2.Cannot violate the original Employment Contract.
3.No adverse effect on salary or other working conditions stipulated.
4.Works after transfer should be in employee's sphere of competence.
5.If work place after transfer is too far, employer should provide subsidy or assistance.
