The Labor Standards Act May Limit the Dispatch Ratio to 3%
The number of dispatched job is about 33,000 in April. The Council of Labor Affairs (CLA) is planning to add a chapter considering dispatched labor in Labor Standards Act, in order to increase employer liability and to protect dispatched workers.
The enterprises have no limit in using dispatched workers so far. In order to reduce the motivation for enterprises to use dispatched labor, the CLA is planning to amend the Labor Standards Act to limit the dispatched ratio in an enterprise. According to the draft plan, the dispatched worker number in each enterprise can not exceed 3% of total employee number. With the agreement from Labor Conference of the enterprise, the ratio could be 5%. If the Labor Union agrees, the ratio could increase to 20%.
The CLA is also planning to increase the joint liability on the working enterprise. Both the dispatch agency and the working enterprise should have the responsibility to pay the salary to dispatched workers. The prevention of sexual harassment, sexual discrimination, and employment discrimination are also important liability on the working enterprise.
