CLA Announced Special Chapter Draft for Dispatched Workers
After discussing for more than half year, the council of labor affairs has announced a draft of Labor Standards Act, with a special chapter for dispatched workers.
The draft limits the rate of dispatched employees to total employees in a company, and the rate can not exceed 3%. With the agreement from labor conference, the rate can be extended to 5%; with the agreement from labor union, the rate can be extended to 20%. Currently, there is no any limitation.
The draft also announced that 6 businesses are forbidden to use dispatched workers (i.e. Medical staff, security personnel, aviation personnel, navigation personnel, public transport drivers, mining personnel.)
The special chapter draft rules that the dispatching agency can not sigh fixed-term contract with labors. The dispatching agency has to remain normal employment relationship with dispatched workers. Most dispatching agencies might become illegal and need to adjust their contracts after this draft passes the three readings in Legislative Yuan.
